I don't want to get into a legal argument here, especially since I am not a lawyer, but once you are actually inside the country, my understanding is that a law enforcement officer needs due cause to stop you. Having a person who looks Mexican in your car which is on a public road is not due cause, even if you are taking a route that enables you to avoid a checkpoint. Driving off road to avoid that checkpoint, on the other hand, probably is due cause. Now, just beacause they can't legally stop you does not mean that they won't do so anyway.
