Well, O'Connor is retiring from the Supreme Court. Given his age and state of health, you can bet Rehnquist isn't far behind. So now Bush gets to stack the court in his favor (or at least try). Somehow I'm betting those confirmation hearings are going to get ugly.

He could replace Reinquist with Hitler and it would be business as usual, but O'Connor is 50/50 on issues. Her leaving could be very, very bad.

It would probably be too much to ask for a moderate to get the new slot. Not too left, not too right....Oh, well, I guess the Nuclear option will be back up over this one....

If Bush picks a conservative who actually gets to serve on the Court, and then Roe v Wade is overturned, that would be the end of the Republican Party as we know it.

Well, at a glance it appears Bush has thrown down the gauntlet on his Supreme Court nominee. A quote from a brief his nominee John Roberts co-wrote in 1990: "The court's conclusion in Roe that there is a fundamental right to an abortion ... finds no support in the text, structure or history of the Constitution".
