Governor Spitzer has fallen. His crime? Guilty of the same moral terpitude we so freely enjoy - even if we ARE forced to partake in other countries.

Why does the USA condemn prostitution as criminal behavior? Is it our 'religious morals'? Because in the past few decades we've witnessed the complete annihilation of religion in our society according to the 'separation of church and state' doctrine which, although not a constitutional right, has nevertheless been triumphed by every sect of American society seeking to overturn public perception, opinions and laws.

For example:

No more prayer in schools.

No more Merry CHRISTmas, it's 'Happy Holidays'

No more homosexuality is 'just wrong'

No more 'porn doesn't belong in our society'

No more 'abortion is murder' (ok, even though they fight this one, federal laws are still very liberal in favor of abortion)

No more 'you can't drink from this fountain'. Even if this wasn't an issue based on religion, it WAS a cornerstone of southern 'bible belt' society.

Pioneers like

Ed Schempp, Plaintiff In 1963 School Prayer Case

Martin Luther King of the civil rights movement

Norma McCorvey aka 'Jane Roe' in Roe v Wade

Larry Flint, Hustler

Legions of Gays & Lesbians who dared step out of their closets

These people took a risk and made a difference in our society. But who marches for our cause?

No one.

And yet, prostitutes by the millions operate illegally every day in the US as

strippers,
escorts,
masseuses (even if they ARE Koreans with big knuckles),
web cam actresses
etc...

But wait - prostitutes can operate legally in Nevada!? If prostitution is legal in Nevada, why can't it be legalized nationwide?

One person can make the difference. And what a difference it would make too.

Once legalized in Canada, prices immediately began to fall!

Can you imagine :

getting a legal incall escort for under $100?

having her care about her reputation?

not having to look over your shoulder while some bitch is in your car, hunched down, tuggin root & chuggin' nuts?

We need a lone plaintiff who dares challenge the constitutionally of our anti-prostitution laws.

That man or woman would earn his or her place in history as being the person who finally brought our laws into step with our practises.

I have a dream, that men and women will be free; free to practise the worlds oldest profession - without fear of reprisal.

Could the argument be made that since the Federal Government recognizes Nevada's right to allow prostitution on a state level, then prostitution already IS legal, and it is unconstitional for states to deny it?

Canada has 11 provinces and they passed federal prostitution laws that govern all the provinces. We should be able to do it too.

I can only imagine GCL as our posterchild. He could travel around the country in a motorhome, proving how clean and disease free the women of america are by offering free STD checks & ass waxings.

I posted this elsewhere on this board, but thought it will be good here too. It may sound funny, but for being "normal" men with absolutely normal urges, we are chastised, and the issue is severely overlooked.

Hundreds of years ago is was commonplace for a man, if he could afford it, to have a few wives of differing ages, and a number of concubines. Then the church took over, and normal sexuality had to be pushed underground while the priests got to butt-fuck each other and local town teenage boys. Today things are not too different. We see hoards of men going to church with their families each Sunday, and 80% of them are sexually frustrated trying to take the edge off by masturbating to internet porn at 3am. Many can not afford the luxury of hobbying, keeping a young lover (which requires cash no matter where you live) or soliciting an occasional escort for a decent round. All this shit leads to increased psychological/physiological disease in men................and nothing is being done about it.

If prostitution were legal, the prices would drop so more men could get their grove on and be happier/healthier; dysfunction in families would decrease since men would be generally better parents; there are so many benefits that outweigh any trouble.

The big question is, who is going to be the spokesperson? Who will be the messiah? We would all stand behind him, saying, "well yeah he's got a good point, but I don't care because I would never use a prostitute anyway," since most women we would eventually marry would find the issue disturbing. What a fucking mess eh? I believe it can happen, but someone, or some group of people, will have to get the ball rolling UPFRONT and not hidden behind internet protections.

Well, so much misinformation, so little time.

Laws outlawing prostitution are not federal laws. The federal government can only pass laws outlawing prostitution that apply to federal jurisdictions, armed services, etc. If the federal government in the US tried to pass a law legalizing prostitution (sure, that's going to happen), it would be declared unconstitutional by the courts. Article I, Sec. 8 of the Constitution (the so-called enumerated powers clause) and the 10th Amendment limit the authority of the federal government in most areas of domestic policymaking.

The feds can get involved, if they wish, by threatening states who pass legislation they don't like with loss of federal dollars. Remember when all states raised the drinking age to 21? They did so because the feds threatened to withhold highway funds from states who didn't raise the drinking age. The courts said this was OK, because the states were free to turn down the federal funding and keep the drinking age set at whatever age they desired. Right. But had the feds simply tried to establish a federal drinking age limit, the courts would have struck it down under Article I, Section 8.

Anti-prostitution laws are state and local statutes. If you want to be a champion for the rights of mongers and hookers, get yourself elected to a state legislature, introduce legislation to either decriminalize or legalize prostitution, and then be prepared to be defeated when you run for re-election. You'll need to start at the state level, because except for Nevada, state laws are written in order to pre-empt the ability of localities to pass their own legalization/decriminalization statutes. Once you get your state to pass such a law, then you have to get similar laws passed on a locality-by-locality basis.

Given this context, it seems a lot simpler to get on a plane, fly to Rio or AC or Medellin or Pattaya or wherever, and have your fun there. It's hard to envision that local services would match up to these places in terms of prices or quality.

Class dismissed.

Of course, this all begs the question of who would want to have sex with a gringa puta anyway.

But I'm all in favor of GCL and DonGringo being our pro-prostitution poster children. I have some photos of the two of them that would make good posters.

You might find that Mr Spitzer has actually made prostitution legal in both NYC and Washington, DC.

I believe it is now a well established fact that he has has prostitutes in both locations.

If it turns out now that Spitzer is not prosecuted, then how could anyone else be prosecuted?

Anyone else being prosecuted if Spitzer is not prosecuted would have a good claim to selective prosecution.

If selective prosecution could be proved, then you could then get the case thrown out on that basis.

Would it not be wonderful if Spitzer by his actions actually has actually legalized prostitution?

The feds have already reached so far over this limit (and been allowed to get away with it - I submit your drinking age example as one point in fact) that we may as well just call this article of the constitution dead, just like many others.

The point is the feds can use their power of the purse to push and cajole states into taking certain policy positions, but the feds can't pass statutes in those areas.

There was an interesting example of something like this on the international level a few years ago. The US decided to make receipt of USAID HIV prevention funding by foreign governments contingent upon those governments taking an explicit anti-prostitution position. Brazil said "go fuck yourselves, you can keep your $40 million." Every other country eligible for the $$ kowtowed to the US in order to get the money. Another reason why I love Brazil...

What Bwana_dik states is true, and yes the Fed have used much of the constitution as ass wipes, especially of recent.

Regardless, what would need to occur first and foremost is a generalized rise in consciousness amongst WE THE PEOPLE, men and women alike, about how stupid anti-prostitution laws actually are, and how all men, when horney and given the opportunity, will attempt to get laid even if by some means they have to pay for it.

The whole "escort" business has gotten around it nicely here in NY, CT and other northern states. If some crusaders could take the time and effort to attempt to get laws changed similar to Nevada, then over time the other states would follow.

It could be marketed to state lawmakers as a way to keep prostitutes off the streets, safe for both girl & John, better for state revenue since it can now be TAXED!!!! A biggie there. It could be regulated at the state level for health safety, subject to inspections which also brings in more revenue for licensing of varying types. Wouldn't you just love to see a state license that read, SEX WORKER! It could also include varying discrete methods of display and advertising as to not effect children and families, instituting more jobs at the state level for inspectors. Jese, you would think loves of bureaucracy would jump at the opportunity to legalize prostitution.

The criminalization of prostitution is stupid, and drives those practicing "the oldest profession" underground, which is bad for everyone.

Legalization, on the other hand, would be a real mixed blessing. Have you been to Nevada? Prostitution is highly regulated there, and is consequently highly expensive and quite boring. Do you like CBJs? Because you can't legally receive a BBBJ from a prostitute in Nevada. Do you like GFE sex? Forget it. Nevada prostitutes are discouraged from any kissing. Most of the Nevada hookers I've seen are well past their prime. Choosing sexual services from a menu? As in I'll have two-way special (CBJ and covered vaginal, one orgasm, plus back massage) for $1000?--no thanks! It's a great place for very safe, very boring, very over-priced sex.

Decriminalization, on the other hand, would be more appealing.

But, I repeat my earlier point: who would want to have sex with an American whore? In this era of globalization, American sex workers don't compete well with their sisters abroad, either in terms of price or quality of services. Until we can change the immigration laws so that GCL can open a real Brazilian termas in Alabama, I'm taking my business elsewhere. You could remove all legal barriers to prostitution in the US and I'd still be booking regular flights to Brazil, Thailand, Argentina, the Philippines, etc.

A lot of people. There are a vast army of websites dedicated to just exactly this. (Hell, there's even a television channel, if you count E!)

Whoring is the ultimate objectification of women - they become just a life support system for the ass/pussy/mouth/armpit/whatever that you're paying to fuck. Right now you could hit another website, look up the current hooker hotspots in the big town nearest you, and be enjoying a 20 or 40 dollar BBBJ in however long it takes you to get there, plus 20 minutes.

Compare that with flying to WhereEverYouGo-bia and partying for a week. Is it more "fun"? Sure. But is it cheaper to shell out for a plane ticket, hotel, etc.? Of course not. Decriminalization *would* increase things like reputation sensitivity, and would re-validate parts of the market. It addresses some of the market factors already.
