LaredoJim, Kennedy and O'Connor are only seen as "moderates" in comparison to Rehnquist, Scalia, and Uncle Thomas. But then again, so would Hitler and Attila the Hun. They can not be counted on to go ultra-rightward with the other 3 100% of the time. But they are expected to do that most of the time, and those 5 are said to make up the present conservative majority of the Court...albeit there are gradations within any ideological demographic. As for O'Connor, she especially disgraced herself in this process. One of the justices' law clerks revealed that O'Connor mused during the deliberations that she wanted to retire within the next 4 years, but needed to have a Republican in the White House to replace her. The entire majority decision is seen as blatantly partisan, but in O'Connor's case, it's an outright conflict of interest...she should have recused herself.
